Requirement for wholesalers to register: alcohol duty

New legislation will be included in the Finance Bill 2015 following the Budget, which took place on March 18, amending the Alcoholic Liquor Duties Act 1979. This legislation is being introduced in order to address illegal operators and illicit trading in the market, to help prevent tax evasion, and to reduce unfair competition.

Businesses buying and selling alcoholic drinks for wholesale, at or after the duty point, will be required to be registered with HMRC. Furthermore, it will be necessary for wholesalers to apply to HMRC demonstrating that they are ‘fit and proper’. For the purposes of the legislation, wholesale is defined as “the sale of liquor in the course of the trade or business of the seller to a buyer in the course of the buyer’s trade or business”.
