Last month Elena observed that fines in Scotland were on the rise and pointed to the sentences handed down to Robertson Construction Central and Stirling Stone, where the Sheriff fined both companies in that case £200,000.
It’s interesting to look at these fines in the context of financial performance. Accounts demonstrated that Robertson Construction Central and Stirling Stone had made pre-tax losses of £864,000 and £180,572 respectively.
In this case at least, it doesn’t appear that ability to pay was central to the Court’s decision-making on the level of fine to impose.
