Bancon were refused planning permission by a reporter on appeal for a housing development at Upper Arbeadie, Banchory. They appealed to the Court of Session, which quashed that decision. That revived Bancon’s original appeal, which has just been refused planning permission by a second reporter. An illustration of the risk of winning the battle, but losing the war (unless Bancon re-apply or run another legal challenge).

It also shows time doesn’t stand still – the second reporter took account of 2 planning permissions granted after submission of Bancon’s appeal.
