Public Law

A snapshot from the “emergency” legislation process. Niall’s earlier blog asked why extend detention, and why allow the police to extend detention for up to 24 hours? In arriving at 24 hours, Justice Minister Kenny MacAskill explained that the Scottish Government consulted on this proposal with… the police, the prosecutor, and the Law Society of Scotland. Two of these consultees were in favour of extending to 24 hours and one was not. Can you guess the odd one out? See paras 19-21 of the policy memorandum on the bill for the answer.
