New permitted development rights are being introduced for householder development in Scotland from 6 February 2012. these rights grant deemed planning permission, thereby avoiding the need for a planning application.

Amongst the changes, the specific rights for solar PV and solar thermal equipment on houses and flats, and free standing solar, are being deleted – it’s not clear if that’s because they are included in some of the more general new rights, or if the Scottish Government have decided to remove these rights. Hopefully the circular which is due to be published in December will clarify that.
