The Fallago Rig wind farm consent was unsuccessfully challenged in the courts. The judge has decided that the objectors have to pay the costs of the Scottish Ministers and the wind farm company, because the company had a sufficiently independent interest requiring protection as to justify separate representation. The company were also awarded an additional fee because of the complexity of the case and the voluminous documents. This might encourage future objectors to cap their financial liability by trying to obtain a protective costs order.
