Our construction team continue to assist clients to navigate current issues cropping up in the industry to ensure that projects get on site, appropriate procurement methods are selected, consideration of relevant risks and available protections are in place for interested stakeholders and that parties work together at the outset and throughout the course of projects to reach reasonable positions.   • JCT 2024 - JCT has published the long awaited 2024 Edition of the widely used JCT Design and Build Contract – we will look at what's new and what to look out for 
  • Operating in industrial sectors- we often deal with projects where there is an interaction and interface between plant contracts and civils contracts (for example distillery contracts) - what contractual measures need to be considered?
  • Sustainable construction – what contractual provisions and measures can parties take in relation to contracting for sustainability? 
  • Caselaw update – we will look at recent caselaw including the case of The Engine Yard Edinburgh Limited and Allenbuild Limited v Bayne Stevenson Associates Limited [2024] CSOH 13 in which Brodies acted which provided useful guidance on prescription in the context of delivery of collateral warranties
