Significant changes to the rules on right to work checks came into force on 1st October 2026.

These extended the requirement to carry out right to work checks to workers, certain subcontractors and others. In addition, a new basis for liability was introduced meaning that contractors and other service providers may be liable for civil penalties in respect of workers and others engaged by third parties whom they sub-contract to.

This webinar will focus on how the changes may impact the construction sector:

  • how to assess who in your “non-employee” workforce you have to conduct right to work checks on from 1st October;
  • the impact of civil penalties on a sponsor licence and other risks;
  • contractual changes you may need to make to sub-contracting / supply chain arrangements to avoid civil penalties for third party workers;
  • what due diligence/ verification systems need to be in place; and
  • other practical steps to take to mitigate risk.
