During the Brexit transition / implementation period we advised a number of leading food and drink companies, including various Scotch whisky producers, on their 'Brexit readiness' activities to ensure continuity of market access during and beyond the transition period.

We supported our clients on a range of potential compliance measures including: appropriate changes to product labels; the appointment of an EU based distributor or importer; and the creation of a new legal entity in the EU to serve as the designated 'food business operator' for regulatory compliance - a specific requirement under EU food law.

Key highlights

  • Advising on post-Brexit compliance requirements, including changes to product labelling and distribution activities to ensure continuity of EU market access.
  • Drafting a bespoke distribution agreement to facilitate the appointment of a 'food business operator' in the EU responsible for maintaining product compliance and thereby mitigating Brexit related market access disruption.

Outcome

Our product regulatory team has a special blend of experience with niche expertise in advising clients on the compliance obligations relating to EU and UK product labelling rules, post-Brexit market access requirements and marketing and promotion strategies. This expertise allowed our clients to implement appropriate commercial arrangements that were tailored to their business and facilitated continued trade with their core markets in the UK and throughout the EU.
