When relationships come to an end, there are strict time limits for sorting out the finances of a cohabiting couple. In those circumstances, practical and strategic advice is imperative.
We provide clear advice to cohabitants on what financial claims they can make against one another if the relationship ends and advise on the best course of action to resolve the situation. If matters can be agreed this needs to be properly recorded.
The various ways to resolve matters are the same for former cohabitants as they are for spouses. The types of claims a cohabitant can make against the other are different though – for example, there is no obligation to provide ongoing financial support unless there are children.

"They treated me in a sensitive way during a very difficult and emotional time. They explained everything very clearly, laying out the options and advising on what they felt was best, without pressuring me."

In the few circumstances where matters cannot be resolved through proper advice and sensible discussion, we have extensive knowledge in how cases should be presented to a court to determine any financial claims between cohabitants.
We regularly advise Scottish nationals living in the rest of the UK or abroad how a potential cohabitation claim in Scotland may affect them and how to ensure they are properly covered with an agreement.
