Our most frequently asked questions:
-
Do I need to consult a divorce or family solicitor following separation from my spouse/partner?
It is advisable to consult a divorce solicitor so that you can find out what rights and obligations you have following separation.
The solicitor can advise you in relation to the financial matters arising out of the separation and any child related matters. This will help you to feel more informed, and remove some of the uncertainty that is often faced during a separation.
It is important to note that any claim against a former cohabitant in Scotland requires to be made within one year of the date of separation. It is therefore advisable to seek legal advice as soon as possible following separation.
-
Can I consult a family law solicitor anywhere in the United Kingdom?
When it comes to family law, Scots law differs greatly from the law in other parts of the UK. Accordingly, if Scots law applies to your situation, it is essential that you consult a solicitor qualified in Scots law.
If you require advice in relation to which country has jurisdiction in relation to your situation, please contact a member of our family law team.
-
Can my partner and I consult with the same solicitor?
No. In terms of the Law Society of Scotland professional rules we can only represent one of you. There would otherwise be a conflict of interest.
What our clients say about us
Family law client, Google review
Excellent advice and appreciated the personal service in what can be a stressful time for those involved. Shaun and his team were very attentive to my needs.

Lisa Girdwood at Brodies LLP recently handled my divorce which was exceptionally challenging and emotional distressing for me…She was not just professionally empathetic but checked up on me prior to weekends when she knew communications from my ex-husbands legal team would be upsetting me. This was above and beyond her duties and shows not only is she in my mind, the best divorce lawyer in Scotland but one who genuinely cares about her clients.

I like everyone who finds themselves at the point of divorce was worried about the process the legal jargon etc…Sarah instantly made me feel a ease with explaining things clearly and respectfully I knew then I'd made the right decision on Brodies. Every step of the process was well informed professional and quickly handled.
I can't recommend Brodies enough they are extremely great value. I'd urge anyone in the position I was in to contact them without hesitation.
