The Privy Council recently abolished the long-standing ‘Shareholder Rule’ exception to privilege. For almost 140 years, the ‘Shareholder Rule’ had prevented companies from asserting legal advice privilege against their shareholders in litigation.

We looked at the practical implications of this landmark decision for companies whose shareholders are in dispute, and what advice is now protected by privilege. The session also offered practical tips to companies seeking to navigate disclosure requests in the context of shareholder litigation.
