Since we blogged last week, the Scottish government has opened a consultation on the devolution of the management and operation of employment tribunals to Scotland.
We explained the proposals in our last blog, highlighting that the draft regulations, in their current form, could facilitate 'forum shopping' i.e. that claimants in other parts of the UK, working for a business with a Scottish arm, might seek to raise their claim in Scotland. This could become particularly significant if tribunal fees are abolished here but retained in England and Wales.
