From 6th April 2019, the FFI hourly rate charged by HSE has increased from £129 to £154. The fee is invoiced to dutyholders if they are found to be in material breach of health and safety law. Dutyholders are obliged to pay HSE for their time identifying the breach and any subsequent action required. FFI only applies where there is a material breach of the law. If, on inspection, there is no material breach, no FFI will be applied. More guidance on FFI and how it is applied can be found on the HSE's website here.
