New regulations will come into force on 16 May 2017, implementing the Environmental Impact Assessment (EIA) European Directive 2014/52/EU.

Eight sets of Scottish regulations are being amended or replaced.

These affect Agriculture, Forestry, Roads & Transport, Energy and Marine sectors.

Compliance with the new regulations is essential. We have previously blogged on 2 cases where planning decisions were quashed because of such a failure: Stronelairg wind farm and the judicial review of 4 offshore wind farms by the RSPB.

We are preparing an advice note on The Town and Country Planning (Environmental Impact Assessment) (Scotland) Regulations 2017 and will advise when it is available.
