I wrote last week about the Scottish Government's response to the results of its consultation exercise on extending the coverage of the Freedom of Information (Scotland) Act 2002 (FOISA).
Readers may be interested to know that the Scottish Government has now published the draft order under section 5 of FOISA giving effect to its proposals.
As expected, the order extends FOISA to cover contractors or sub-contractors who run privately managed prisons, providers of secure accommodation for children, grant-aided schools and independent special schools.
The draft order also extends FOISA to cover Scottish Health Innovations Limited, which is an NHS arm's length organisation created to safeguard intellectual property rights arising out of ideas developed by NHS staff in the healthcare field.
This organisation was not included in the consultation exercise, but presumably it was discussed with the company behind the scenes and will not come as a surprise to them.
