Whilst many professionals in local government have been conscious of their obligations in respect of the Equality Act 2010 for some time, 2019 brought a notable surge of equalities or ECHR challenges within the social housing sector. It was argued that a landlords failure to comply with the 2010 Act or the ECHR was a defence to an eviction action or gave rise to a claim for damages.

This seminar will discuss the requirements of social landlords to ensure compliance with the legislation to avoid any prospective challenge. We will also review emerging trends through the Courts within the UK and Europe in relation to social housing, and consider whether this could be a precursor to the future of litigation in Scotland.
